Terms of Service

These Terms of Service apply to services provided by Creative Sparrow Graphic Design, operated by Danielle Bonnington (ABN 29 095 780 204).

By purchasing or booking a service from Creative Sparrow, you agree to the terms outlined below.

These terms apply to all services provided by Creative Sparrow, including packaged services, hourly design support, project-based work, and any services purchased through the website or private booking links.

Examples of services may include, but are not limited to:

  • Farmer Wants a Logo
  • Farmer Wants to Make It Official
  • VIP Creative Day
  • Hourly or short-form design support services

1. Booking and Payment

All services are paid in full at the time of purchase unless otherwise agreed in writing.

Once payment has been completed, your booking is confirmed. Creative Sparrow will contact you to arrange onboarding, project details, and scheduling where required.

Creative Sparrow reserves the right to decline or reschedule a booking if scheduling conflicts, incorrect service selection, or unforeseen circumstances arise. Where a suitable booking arrangement cannot be reached, Creative Sparrow may, at its discretion, issue a refund.

Final design files will not be delivered until all invoices related to the project have been paid in full.

If additional work outside the original scope is required, Creative Sparrow may invoice for the additional hours and final files may be withheld until those invoices are settled.

If invoices remain unpaid and debt recovery action becomes necessary, the client agrees to be responsible for any reasonable costs associated with recovering the outstanding amount, including debt collection agency fees and administrative expenses.

2. Scope of Services

Each service includes the deliverables described on its individual service page or as confirmed during booking.

Farmer Wants a Logo

A streamlined logo design service designed for agricultural businesses needing a professional logo.

Final deliverables typically include:

  • primary logo file
  • alternate logo variations where applicable
  • files supplied in common formats suitable for web and print use such as PNG, JPG, and vector formats

Exact deliverables are outlined on the service page.

Creative Sparrow takes reasonable care when creating logo concepts to avoid obvious similarities with existing brands. However, Creative Sparrow does not conduct trademark searches and cannot guarantee that a logo or brand mark is legally available for trademark registration or exclusive use.

The client is responsible for conducting any trademark searches, legal checks, or intellectual property registrations required for their business. Creative Sparrow is not liable for trademark conflicts, registration issues, or legal disputes arising from the use of a logo after it has been delivered.

Farmer Wants to Make It Official

An add-on service that provides support rolling out the new brand created through Farmer Wants a Logo.

This may include guidance and design support for applying the new logo and brand across practical materials such as signage, documents, social media, or other business touchpoints.

This service is offered at a discounted bundled rate when purchased together with Farmer Wants a Logo. If purchased later as a standalone service, pricing may differ.

VIP Creative Day

A dedicated day of focused creative support where Creative Sparrow works intensively on agreed priority design tasks.

Rather than specific fixed deliverables, the day is used to complete as much agreed work as possible within the scheduled timeframe. Typical work may include design updates, layout work, collateral design, rollout tasks, or troubleshooting design challenges.

The scope of work for the day will be confirmed before the scheduled date.

Hourly or Short-Form Services

Some services may be purchased as blocks of time or short design sessions. In these cases Creative Sparrow will provide design support for the duration purchased and will complete as much agreed work as reasonably possible within that time.

3. Client Responsibilities

To help projects run smoothly and on time, clients agree to:

  • provide requested information, content, assets, and feedback in a timely manner
  • respond to communication within the timeframes required for the service booked (for example Farmer Wants a Logo stages may require responses within a few days, while VIP Creative Day collaboration may require real-time or same-day feedback)
  • review and approve work carefully before final approval
  • ensure all supplied materials are accurate and ready for use

Delays in providing required materials or feedback may result in changes to the delivery timeline.

4. Revisions and Additional Work

Each service includes a defined scope of revisions as outlined on the relevant service page.

Additional revisions, change requests, or work outside the agreed scope may incur additional fees.

If extra work is required, it will be quoted or charged at $150 per hour + GST, in 15 minute blocks.

5. Project Delays

If the client does not provide required materials, feedback, or approvals within a reasonable timeframe, Creative Sparrow may:

  • adjust the project timeline to reflect the delay
  • reschedule the work based on current availability
  • apply an additional fee of up to 25% of the total service fee where delays cause significant disruption to scheduled work

This fee helps cover rescheduling, reallocation of time, and the impact on other booked work.

6. Cancellation and Rescheduling

Because many services involve reserving creative time in advance, the following cancellation terms apply.

Client cancellations

If a client cancels a booking, payments made are non-refundable.

If sufficient notice is provided and work has not substantially commenced, Creative Sparrow may, at its discretion, allow the booking to be rescheduled once to a new date or timeframe.

Creative Sparrow cancellations

Creative Sparrow reserves the right to cancel or reschedule a booking if circumstances prevent the service from being delivered as planned.

If this occurs, the client will be offered either:

  • a rescheduled booking
  • a refund for any portion of the service not yet delivered

7. VIP Creative Day Preparation

VIP Creative Day bookings require preparation before the scheduled day.

Clients must provide requested briefing information, content, assets, access details, and any other required materials ahead of time.

If preparation requirements are not met, Creative Sparrow may reschedule the booking to protect the value and usability of the day.

8. Intellectual Property

Upon full payment, the client receives the rights to use the final approved design files supplied for their project.

Unused concepts, drafts, and exploratory work remain the intellectual property of Creative Sparrow unless otherwise agreed in writing.

Creative Sparrow retains the right to display completed work, selected concepts, and project outcomes in portfolios, case studies, social media, and other promotional materials.

9. Portfolio, Design Credit, and Testimonials

The client agrees that Creative Sparrow may:

  • display completed projects for self-promotion and portfolio purposes
  • publish testimonials, reviews, or feedback provided by the client
  • credit Creative Sparrow on websites designed by Creative Sparrow where appropriate

Clients may withdraw consent for testimonial use by notifying Creative Sparrow in writing.

10. Communication

To keep projects clear and well documented, most communication should take place by email unless otherwise agreed.

Any changes discussed verbally may be confirmed by email to ensure both parties have a clear written record.

11. Proofing and Approval

Approval is required before final files are released.

Clients are responsible for carefully reviewing all work before giving final approval.

Creative Sparrow is not responsible for spelling, grammatical, numerical, or other content errors once final approval has been given.

12. Turnaround Times

Creative Sparrow will make every reasonable effort to meet quoted timelines and project milestones.

Any turnaround times provided are estimates only and may be affected by client responsiveness, scope changes, complexity, or unforeseen circumstances.

Creative Sparrow is not liable for losses, costs, or delays resulting from late approvals, late supply of materials, or delays beyond reasonable control.

13. Images, Fonts, and Third-Party Materials

Some projects may include stock images, licensed fonts, merchandise, print production, or other third-party materials.

Where this applies:

  • approval will be obtained before purchase where appropriate
  • any additional licensing or purchase costs may be invoiced to the client
  • Creative Sparrow may provide links or instructions where the client needs to purchase a licence directly

For services such as Farmer Wants to Make It Official, Creative Sparrow may assist with sourcing or coordinating physical items from third-party suppliers.

Unless otherwise stated, the service fee covers Creative Sparrow’s professional design and coordination services only. The client is responsible for all third-party production costs including manufacturing, printing, shipping, supplier fees, and any applicable taxes.

14. Colour, Printing, and Production Variations

Colour may vary between screen display and final printed output due to differences in screens, printers, materials, inks, and production methods.

Screen proofing is not an exact representation of final printed results.

15. Confidentiality

Both parties agree to keep confidential any non-public business or project information shared during the course of the project.

16. No Guarantees

Creative Sparrow provides design services with professional care, skill, and experience.

However, Creative Sparrow cannot guarantee specific business, marketing, legal, or commercial outcomes from any design service.

17. Force Majeure

Creative Sparrow will not be liable for delays or failure to perform obligations where such delay or failure results from events outside reasonable control.

18. Limitation of Liability

To the maximum extent permitted by law, Creative Sparrow is not liable for indirect or consequential loss arising from the use of any design work or services provided.

Creative Sparrow’s total liability is limited to the total fees paid by the client for the relevant service.

19. Dispute Resolution

If a dispute arises, both parties agree to first attempt to resolve the matter through good faith discussion.

If the dispute cannot be resolved informally, the parties agree to attempt mediation before commencing legal proceedings.

20. Governing Law

These Terms of Service are governed by the laws of the Australian state in which Creative Sparrow operates.

21. Acceptance of Terms

By purchasing a service from Creative Sparrow, the client acknowledges and agrees to these Terms of Service.
